Actor, Jussie Smollett, from the hit show “Empire”, made national news when he alleged he was attacked by two men in a racist, anti-gay hate attack. However, recent reports suggest that the actor may have staged the attack, paying two brothers to carry it out. Smollett was charged last Thursday with felony disorderly conduct for allegedly filing a false police report. Illinois Statute (720 ILCS 5/26-1) states that a person commits disorderly conduct when he or she knowingly transmits a false report.
In Florida the filing of a false report is not encompassed in the charge of disorderly conduct as our State has its own statute for that. Disorderly Conduct and False Reporting are both misdemeanors in Florida, however, given the nature of the alleged false report by Mr. Smollett it would be considered a Class 4 Felony.
